How does Bhardwaj Law Professional Corporation handle divorce cases in Ontario, Canada? At Bhardwaj Law Professional Corporation, we specialize in family law matters, particularly divorce cases within the Ontario jurisdiction. Our focus is on 'sole/uncontested' and simple joint divorces, ensuring a streamlined and efficient legal process.
-
What types of divorces does your firm handle? We exclusively handle 'sole/uncontested' and simple joint divorces. A 'simple' divorce entails seeking only the dissolution of the marriage without additional complexities such as spousal support, child custody, and property division.
-
What is a 'sole/uncontested' divorce, and how does it work?In a 'sole/uncontested' divorce, one spouse initiates the process by filing for divorce. The other party is then served with the divorce papers and has a specified time frame to contest or present their claims. If uncontested within the allotted time, the divorce proceeds and is typically finalized by the court within a few weeks.
-
Is a joint divorce more convenient, and how does it compare to a sole/uncontested divorce?Whether opting for a simple joint divorce or a sole/uncontested divorce with both parties cooperating, the timing and cost remain consistent. Many couples prefer the convenience of a joint divorce, while others choose the sole/uncontested route for its simplicity, especially when one spouse efficiently handles the paperwork.
-
How do you facilitate document processing for clients?Signing documents is made effortless through our digital platform. We use DocuSign to allow you to sign forms from the comfort of your home. Additionally, we leverage Zoom for swearing affidavits over your computer or smartphone, ensuring a smooth and convenient process.
-
Where is Bhardwaj Law Professional Corporation located, and which markets do you serve? We are located in Ontario, Canada, and our services cater to clients across the Canadian market. Our expertise in Ontario family law allows us to provide dedicated and knowledgeable assistance to clients seeking legal support in family matters.
-
What paperwork will I need to initiate my divorce process with Bhardwaj Law Professional Corporation? To begin the divorce process, you will need either your original marriage certificate or a certified copy issued by the governmental agency responsible for issuing certificates. If you do not have a copy, you can easily order a replacement Ontario marriage certificate by clicking (link to ordering page).
-
Can you explain the process of a 'joint' divorce?A 'joint' divorce involves both spouses mutually expressing their desire to divorce. Both parties act as applicants, jointly signing the necessary documents—the Joint Application for Divorce and Joint Affidavit for Divorce. While ideal for amicable separations, logistical challenges, such as one spouse residing overseas, may require additional coordination.
-
What if I was married outside of Canada or the US?If your marriage took place outside of Canada or the US, and you've lost the original certificate or only have a photocopy, it's essential to make your best efforts to obtain a replacement certificate. In the event that your efforts are unsuccessful, rest assured that you can still proceed with obtaining a divorce.
-
I got married outside of Canada, and I've been previously divorced. What documents do I need to provide? If your current marriage occurred outside of Canada, and you have a history of divorce, you are required to show proof of the prior divorce. However, if obtaining such proof is currently impossible, there are ways around this requirement, and our legal experts will guide you through the necessary steps. Please note: It is crucial to comply with the legal requirements, and our experienced team at Bhardwaj Law Professional Corporation is here to assist you in navigating through the paperwork and ensuring a smooth divorce process.
-
Can I file for legal separation in Ontario through Bhardwaj Law Professional Corporation? In Ontario, there is no formal process for "filing for legal separation." You and your spouse are considered legally separated when you are 'living separate and apart,' even if you're not necessarily residing in separate homes.
-
How does legal separation work in Ontario?Legal separation is not a process that involves filing specific paperwork in Ontario. Instead, it is a status achieved when spouses are living separate and apart. This separation status allows you to address specific legal matters, such as child custody, support, and property division, without filing for divorce.
-
Can I address custody, support, or property division without filing for divorce?Absolutely. In Ontario, you can file for custody of your children or seek support and division of property without initiating a divorce proceeding. Bhardwaj Law Professional Corporation can guide you through the legal steps necessary to address these specific matters even if a divorce is not immediately pursued.
-
Is it necessary for spouses to live in separate homes to be legally separated? While living separate and apart is a key factor, it's not a strict requirement for spouses to reside in separate homes to be considered legally separated. Bhardwaj Law Professional Corporation can provide further information and guidance based on your specific circumstances.
-
Can I consult with Bhardwaj Law Professional Corporation for assistance in my separation matters?Certainly. Even though there is no formal filing for legal separation in Ontario, our experienced legal team can provide guidance on the legal implications of your separation and help you navigate issues related to custody, support, and property division. Contact us for personalized assistance tailored to your situation.
-
We've been separated for 10 years. Is it true that we are automatically divorced now?No, that's not true. In Canada, there is no automatic divorce, regardless of the length of separation. The misconception that a divorce is automatic after a specific duration, such as 5, 7, or 10 years, is not accurate.
-
How does the duration of separation affect the divorce process in Canada? The duration of separation itself does not determine an automatic divorce. While a separation period is a factor considered in divorce proceedings, the legal process must be initiated through appropriate channels. It's important to understand that separation alone does not lead to an automatic dissolution of the marriage.
-
What steps should we take to get divorced after a long separation? To obtain a divorce in Canada, you need to actively initiate the legal process. Bhardwaj Law Professional Corporation can guide you through the necessary steps, ensuring that you meet the legal requirements for divorce. Simply being separated for an extended period does not trigger an automatic divorce.
-
Are there any advantages to waiting for an extended period before pursuing divorce? While the duration of separation is considered in divorce proceedings, waiting for an extended period does not confer automatic advantages. It's essential to consult with our legal experts to understand the implications of your specific situation and to determine the best course of action for your divorce.
-
Can I consult with Bhardwaj Law Professional Corporation for advice on my long-term separation situation?Absolutely. Our experienced legal team can provide personalized advice based on your unique circumstances. We will guide you through the divorce process, ensuring that you meet all legal requirements and addressing any concerns related to the duration of your separation. Contact us for a consultation tailored to your needs.
-
Do I have to have a separation agreement? No, the court does not require you to have a separation agreement. However, it is highly advisable that you and your spouse reach an agreement on how to settle the issues between you. Court proceedings can be costly and time-consuming, and the decisions you make now can have lasting implications for you and your children.
-
Why is signing a separation agreement important?Signing a separation agreement is a crucial step in the process. While the court doesn't mandate it, having a written, signed, and witnessed separation agreement provides a clear record of the decisions made between you and your spouse. This documentation can be essential in case your spouse fails to adhere to the informal agreement.
-
What information can I find in a separation agreement? The Ontario Separation Agreements provides detailed information about separation agreements. In a properly executed agreement, you can cover vital issues, including: Date of separation Child-related matters: Custody arrangements Access rights for the non-custodial parent Child support details Duration of child support Spousal support: Payment terms Duration of support Waiver conditions, if applicable Property division: Allocation of assets House-related decisions Proceeds distribution from the sale of the house Debt allocation: Responsibilities for outstanding debts Handling debts post-separation but pre-divorce Pension, RRSPs, RESPs, etc.: Consideration of splitting pensions and/or RRSPs Entitlement to permitted transfers for RESPs
-
Why is it important to include all these details in a written agreement?Even if you've been separated for an extended period without minor children and have already divided assets, a separation agreement can formalize these details, preventing future disputes. A properly executed agreement can be treated by the court like a court order, providing legal clarity and protection for both parties.
-
I've just separated - can I start the divorce process now?Yes, you can initiate the divorce process by filing the application any time after you separate*. However, it's important to note that unless your divorce is based on grounds such as adultery or abuse, the court will not finalize the divorce until you have been separated for a year. The Divorce Act stipulates a 12-month period of living "separate and apart," and it's essential to comply with this requirement.
-
Can a separation agreement be beneficial even if we have been separated for many years?Absolutely. Regardless of the duration of separation, having a separation agreement can document the agreements reached, preventing potential claims or disputes in the future. It is a valuable tool to safeguard your interests, even if there are no minor children and assets have been divided. Our legal experts at Bhardwaj Law Professional Corporation can guide you through the process of creating a comprehensive separation agreement tailored to your unique circumstances. Contact us for personalized assistance and advice.
-
Does "separate and apart" mean living in separate homes? No, the requirement to live "separate and apart" for 12 months does not necessarily mean residing in separate homes. Many people successfully obtain a divorce while still sharing the same residence for economic or other reasons. The key factor is that you and your spouse have genuinely lived separate lives during this period.
-
What are the exceptions for a shorter separation period? In cases where the divorce is based on grounds such as adultery or abuse, a shorter separation period may be considered. However, these situations require specific legal documentation and evidence. It's advisable to consult with our legal experts at Bhardwaj Law Professional Corporation to understand the specific requirements and implications for your case.
-
Can I get divorced sooner if we agree on all terms? While reaching an agreement on all terms is beneficial for the divorce process, the one-year separation requirement remains in place unless specific grounds for a shorter period are applicable. It's crucial to consult with our legal team to ensure that your agreement aligns with legal requirements and to streamline the divorce process as much as possible.
